LEGAL SUMMARY OF THE PRE-TRIAL HEARING - MONDAY, JUNE 4TH 2001

PRE-TRIAL MOTION HEARING OF MONDAY, JUNE 4, 2001

In the continuation of the hearings held May 17th and 18th, 2001, to disclose confidential informants and/or sources, representatives of the Mobile (AL) office of the FBI and representatives of the ATF were called to the stand to give testimony concerning the existence, if any, of confidential informants.

The following were disclosed:

Margaret Faulkner, Special Agent of the Montgomery, AL.office of the FBI .

She stated that the person in charge of the Mobile (AL) office, Bill
Imfield, was currently retired. She testified that the confidential 'source' that led to the apprehension of Imam Jamil Al-Amin was a 'thing'. She executed a search warrant based upon a confidential 'source'; however, she could not identify who or what the 'source' was nor could she identify who gave her information concerning said 'source'. With regards to the alledged 'shoot-out' in Alabama, she testified that there is no indictment nor is there one pending.

Under Defense Attorney Jack Martin's questioning, Ms. Faulkner testified that she either doesn't know or someone else - whom she didn't identify - would be in a position to answer questions concerning the existence of a confidential informant(s) Bill Gant, 13-year Veteran of the ATF He stated that no informants were used in the apprehension of Imam Jamil Al-Amin; but Defense Attorney Jack Martin presented a document that countered Mr. Gant's assertion. Mr. Gant then went on to say that there was an open investigation of Imam Jamil Al-Amin in March of 2000; that this investigation was a 're-opening' of sorts and that it was classified (he doesn't know why). Under further questioning, he testified that he turned his investigation over to Special Agent Jack Wagnon. Mr. Gant doesn't know if the investigation continued on into March, 2000 (this revelation differs from
what was earlier said about the re-opening of the investigation). Mr. Gant then testified that confidential informants were still used; he knew this because he's the 'case agent' for the confidential 'source'. He testified that there were telephone conversation between this 'source' and Imam Jamil Al-Amin prior to the Imam Jamil Al-Amin's capture. From Mr. Gant's testimony, it appears as if he had under his supervision another confidential informant/source.

Sharon Hornsby, Senior Supervisor of the Mobile (AL) office of the FBI .

She testified that she 'suprvised' the leads in Mobile, AL., in her attempt to help in locating Imam Jamil Al-Amin while her operations were being overseen from Atlanta. She testified that ultimate command in Mobile, AL., fell under William (Bill) Imfield. Her testimony indicated that the types of confidential informants used were; 'cooperating' witness who was reporting the license plate numbers of automobiles and (taken from an affidavit) another who engaged in telephone calls. She testified that in determining Imam Jamil Al-Amin's location, the 'source' used was not a person. She indicated that Margaret Faulkner and supervisor Keith Baker would be the people who would know about the identify of the prson supplying the information; seeing that this individual was not from Lowndes County, AL.

At this point, Defense Attorney Jack Martin asks to recall Margaret Faulkner to the stand. Before this occured, Bill King, branch chief of the ATF's Washington, D.C. bureau, takes the stand.

James William (Bill) King .

He testified that he was involved in an investigation of Imam Jamil Al-Amin in the 1990s and that there were no confidential informants used. When asked about a current (March, 2000 and on) investigation, Mr. King stated that he was only authorized to talk about the 1990s investigation. In addition to refusing to answer many of Attorney Martin's questions (citing his limited authorization), he indicated someone else (who's in charge of the ATF branch), would know the answers.

Margaret Faulkner (upon being recalled to the stand) .

She testified that this confidential 'source' was paid to move around and get license plate numbers. She testified that this person did not see Imam Jamil Al-Amin's car and when queried as to why she failed to identify this person and their activities in her earlier testimony, she sat silently.

Attorney Jack Martin asked: "Who else is a confidential source?" She indiciated that there was no one else.
