HEARING UPDATE ON IMAM JAMIL AL-AMIN'S CASE A PUBLIC SERVICE BULLETIN FOR DISSEMINATION March 27th, 2001 (10:18am) Superior Court Judge Stephanie B. Manis addressed the litigants on the following three (3) issues:
In addition to the above, Judge Manis meet with DA Paul Howard, Sheriff Jackie Barrett, Counsel and Imam Jamil Al-Amin, to address the matter of security as it relates to Imam Jamil's safety while confined to the Fulton County Jail. RULINGS ON EVIDENTIARY MOTIONS Motion #15 Defense motion to exclude identification evidence (e.g., Deputy English's identification of Imam Jamil as the assailant on the night of the shooting). Attorney Jack Martin withdrew this motion and Deputy English's identification will be admissible during the trial proceedings. Motion #16 Defense motion to reveal "blood-dropping" evidence as a Brady issue. The State indicated that it had no physical evidence that was taken from 1128 Oak Street (address of the Community Store formerly runned by Imam Jamil). Therefore, there's no physical evidence to suppress. Sgt. Scott Bennett of Atlanta's Homocide Division is called to the stand for questioning on the issue of the blood-droppings. Attorney Jack Martin queried the detective on his application of a search warrant based upon the alledged blood-droppings at the crime scene. Sgt. Bennett could not recall who or how he got the information that served as the basis of executing the warrant that was issued. Judge Manis ordered the State to turn over to the Defense documents (incidents reports and supplemental documents) As a Harper issue, this motion was given a continuance (March 28th,2001). As a Brady issue, the Defense's motion was denied. Defense motion to suppress custodial statements made by Imam Jamil. Judge Manis ruled that the issue was moot. Custodial statements are those statements made by a suspect/defendant while being taken into custody by law-forcement authorities. Under Georgia statues, if the state has in it's possession, remarks made by Imam Jamil while he's in custody and they intend to use such during the trial proceedings; then, the State must turn over such to the Defense. In furtherance of trial preparation, Judge Manis sets June 28th, 2001 as the date the State must provide such statements. Motion #18 Defense motion to include Imam Jamil's video-taped statements made to a reporter. Defense has no intention of suppressing this motion. Motion #20 Defense motion for a Harper's ruling to determine the admissibility of ballistics testing. The legal arguments on this issue are not within the public's domain and will be taken up ex-parte. Motion #24 Defense motion to bar any evidence of Imam Jamil's prior convictions and/or bad acts. This statutory issue will be taken up in the April 18th, 2001 hearing. Motion #46 Motion for disclosure for similar transactions (or prior bad acts) will also be taken up in the April 18th, 2001 hearing. Judge Manis addressed the issue of Imam Jamil's safety while he's being housed in the Fulton County Jail. Sheriff Jackie Barrett must give a report of the internal investigation that recently concluded. Attorney Jack Martin is to file a motion for Defense to be provided a "Grand Jury Certificate" (as of the date of this hearing, the Defense has not received this certificate). Judge Manis meets with DA Paul Howard, Sheriff Jackie Barrett, Counsel and Imam Jamil to address the security issues. Court Adjourns LET'S RAISE THE AWARENESS AND CONSCIOUS LEVEL OF THE UMMAH!
